Reply By Aneesh Sharma 17 November 2011 regarding Speak Asia Case
Mr. Jitendra Mohan Sharma, Advocate (Ex-Vice President AOR Association Supreme Court 2010-2011) and Mr. Aneesh Sharma, Advocate ( For J. M. Sharma & Co., Advocates & Solicitors).
At this stage, it can only be said that an application for impleadment has been filed on behalf of new panelists who joined recently. They also claim that they are similarly situated as that of writ petitioners. However, they say that since they have not yet received any benefits till now, therefore, they form a class but in own self and as such are entitled for refund or payment as the case may be, prior to any other group who have already been benefitted earlier, as their claim is superior than others.
The first time joinees/panelists have also been preferred as investors as anybody who initially joins in any business or profession, invests his money in the same and therefore, referred as investors/panelists. This cannot be treated as publicity or soliciting. This is an information to the general public/panelists who want to know or redress their grievances, they have to file application either directly in Supreme Court or through an Advocate.
It is further to state that we have not opened any shop (Dukaan) as said in a video by some Senior Panelist, we are just fighting for the aggrieved persons who have not got justice. They are the one who came directly to us to contest their case, and that is what we are doing as its our profession. We are not doing any sort of negative publicity of any of the persons, so the same we expect from others.
The Hon'ble Court on 14.11.2011 ordered appointment of Justice R.C. Lahoti (former Chief Justice of India) to explore the possibility of amicable settlement. The Court also fixed 21.11.2011 at 11 A.M. before Hon'ble Justice R.C. Lahoti.
Thus the matter is listed before Mediator on 21.11.2011.
